TERMS & CONDITIONS
This document (General Terms and Conditions of Sale) defines the conditions applicable to the sales made between a person purchasing a product via the website, www.kobja.com, of MONIKA JAROSZ CREATIONS company, (hereinafter « kobja » or « Monika Jarosz Creations »). These General Terms and Conditions of Sale apply exclusively to natural and non commercial entities.
The access, the browsing or any other uses of the site imply that you accept in its entirety these General Terms and Conditions of Sale.
1 – Legal
KOBJA’s e-shop, which is accessible at www.kobja.com (the “Site“), which is created by the company MONIKA JAROSZ CREATIONS, a company with capital of €20,000, registered with the Trade and Companies Registry of Paris under number 813 538 337, whose headquarters are found at 84 avenue de la république 75011 Paris (France), represented by its CEO, Ms. Monika JAROSZ.
The director of the site’s publications is Ms. Monika Jarosz, chairman of KOBJA.

2 – Prices
Every price is given in euros all tax included, excluding the participation to the delivery expenses (see paragraph « shipping and delivery »).
Prices are considered valid within 24 hours after being published on the site. The articles will be charged on the basis of the prices published on the site at the moment of the registration of the orders. The articles remain the property of Kobja until the complete payment and cashing of their value by Kobja. This sum is payable in totality and in one payment.
3 – Order
The client places its orders on the website. An order is processed as followed:
Choosing of the articles and placing them in the cart,
Validation of the content of the cart,
Identification on the site if the client is not already registered,
Choice of the payment system and agreement on the General Terms and Conditions of Sale,
Validation of the payment,
The client will receive an email to confirm his order.
Kobja reserves itself the right to cancel or deny any order from a client with which might exist any dispute relating the payment of a prior order or that might represent in the eye of Kobja any form of risk.
Any order is regarded as consent on the price and description of the article available for sale.
Within the limit of available stocks, fob commits to honour the orders received on its website. In case of stock outs, Kobja commits to inform the client without delay, in that case, Kobja will refund the client within 30 days following the cashing of the payment. The order will be automatically cancelled.
4 – Delivery
Every order made on the website from Monday to Thursday, will be prepared the next day (starting on Monday for the orders made between Friday and Sunday), after confirmation of the payment and within the stock limits.
Kobja commits to deliver the articles ordered and paid by the clients within the estimation of time given, except in case of absolute necessity. If the articles have not been delivered within 15 days after the expected day of delivery, the client has the possibility to cancel the sale by sending a registered mail to the given address : Kobja, 84 avenue de la République, 75011, Paris, France.
The sums paid by the client will be reimbursed.
The client must check the state of the articles delivered. Any anomaly regarding the article (defect, missing items, damaged package, broken item, etc.) must be notified within 3 days following the delivery.
The transportation is carried out by La Poste (“Lettre Max”), Coliposte (“Colissimo”), Dhl, Fedex…
The estimated delivery time is:
5 working days after validation of the order for metropolitan France
15 working days after validation of the order for overseas territories and foreign countries.
5 – Payment
The payment of the sales are made by either of the following means :
Credit card : Visa, MasterCard, Carte Bleue, American Express
Or PayPal
6 – Warranty
The client has a period of 2 days after the delivery to express any claim or query about the non-conformity or visible defect of the products delivered, by e-mail to the address contact@kobja.com, or by registered mail to the address : Kobja, 84 avenue de la République, 75011, Paris, France.
Beyond this period and if this procedure is not respected, the articles will be considered as conform and with no visible defect. No claim will be accepted by Kobja.
If the visible defect or the non-conformity of the article is confirmed, Kobja commits to refund or replace the article as fast as possible and with no extra charge. The replacement will be made within a maximum period of 30 days.
7 – Responsibility
Kobja’s responsibility shall not be engaged for wrong execution or non-execution of the contract with a client in case of absolute necessity, the occurrence of a fact attributable to the client or any unpredictable damage and insurmountable problem inherent to the use of the Internet, especially a break in the service, an external intrusion or the presence of a computer virus.
The website www.kobja.com hosts hypertext links possibly leading to the website of a third party. The responsibility of Kobja shall not be engaged by the content of those websites.
The photographs and illustrations accompanying the products on our sites have no contractual values.
8 – Intellectual property
All texts, comments, works, illustrations, videos, sounds and images reproduced on www.kobja.com belong exclusively to Kobja as copyright and intellectual property and for the whole world. Hence and in conformity with the disposition of the code of intellectual property, is authorised only the use for personal use, or can be subject to other and more restrictive dispositions than the code of intellectual property. Any reproduction partial or whole of Kobja’s site is strictly forbidden excepted prior agreement.
